1. The position of transformative constitutionalists is as follows :
a. Of course Blasphemy laws must not exist since they impede free speech;
b. BUT the right to blaspheme must be seen in the context of inequality embedded in social relations.
2. Ergo,filthy jokes on Shivling are acceptable because it is a case of punching up against d majority by groups which r "bullied" whereas Nupur's statement was an act of baiting because she belongs to d majority community. Fantastic way of fuelling the mobs baying for her blood.
3. At a time when the country is witnessing massive mobilisation of Islamist thugs who are being aided by the global Ummah, trust the Left to come out with this position which endangers Nupur's life further *and* provides justification to the bloodlust of the mobs.
4. This is what passes off for constitutional scholarship in this country where facts & history don't matter. Because they mechanically apply scholarship on American race relations to Bharat with no regard for our experience as a Civilisation that has suffered a partition.
5. The fact that Nupur was responding to a clear provocation on the Shivling becomes immaterial since she is expected to suspend her religious beliefs and sentiments merely because she is a member of the majority community and the attacker is a member of the minority community.
6. Don't be surprised if articles,toolkits & Writ Petitions r being prepared right now to justify & defend d violence of d mobs.This is how toolkits were prepared during d anti-CAA riots. The SC will be called upon to defend the "right to an unorthodox protest", meaning violence.
7. And certainly don't be surprised if the Supreme Court entertains such petitions to write a 500-page judgment on how people must be allowed to "let off some steam" in the interest of a healthy vibrant democracy,and we will split hairs on the nuances of a "landmark judgement".
